Fashion by Informa - Referral Program
Terms and Conditions
Advanstar Communications Inc. dba Fashion by Informa and its affiliates (“Fashion by Informa”) organizes the fashion industry’s leading B2B tradeshows in the United States, including MAGIC, PROJECT, and SOURCING at MAGIC (collectively, “Fashion Events”). The Fashion by Informa Referral Program (“RP”) is encouraging registered attendees of a Fashion Event (a “Referrer”) to invite their friends to attend their first Fashion Event (a “Referee”) by submitting an official Referral Program Application Form (“Form”). If the Referrer and Referee successfully attend the Fashion Event specified in the Form at the location and for the duration specified therein (the “RP Fashion Event”) in accordance with the requirements specified in these terms and conditions, each will be eligible to collect a reward.
I. Participation. To participate, a Referrer must complete the Form with all required information about themselves and about the Referee. A Referrer can refer up to a maximum of three (3) Referees per an RP Fashion Event. Forms will be accepted for the relevant RP Fashion Event until 9:00 AM EST of the first day of the RP Fashion Event.
II. Conditions. In order to be eligible to collect the reward, the following conditions must be met:

  1. Referee must be a brand-new store/company of the RP Fashion Event;
  2. the Referrer and Referee must register to attend the RP Fashion Event;
  3. the Referrer and Referee must attend the RP Fashion Event, where their attendance will be verified by having their event badge scanned upon entrance;
  4. the Referrer cannot refer themselves nor can they refer a Team Member; and
  5. the Referrer and Referee must comply with these official rules.
III. Prize. Fashion by Informa will award the Referrer and Referee a $100 gift card (“Reward”) to the extent the conditions provided for in Section 2 are met. The Reward will be delivered to the Referrer and Referee via email within [60] days following the conclusion of the RP Fashion Event. Fashion by Informa will deliver the Reward to the email by addresses provided the Referrer and Referee, and is not responsible for any failure to receive the Reward by its intended recipient due to any electronic issues or otherwise. Fashion by Informa reserves the right to delay issuance of the Reward to investigate and confirm validity of the requisite conditions. Return of any Reward notification as undeliverable will result in forfeiture of Reward. The Referrer and Referee are solely responsible for any applicable tax obligations in connection with the Reward. The Reward is subject to Fashion by Informa availability, is non-transferable, cannot be redeemed for cash, or substituted.
IV. MMGNET Policies. The Referrer and Referee must comply with the Informa Markets Visitor Terms and Conditions applicable to and in effect for the RP Fashion Event, as well as any  RP Fashion Event venue rules. Fashion by Informa has the right to remove a Referrer and/or Referee or prevent their entrance from the RP Fashion Event for any lawful reason at any time, including for any fraudulent or abusive behavior.  
V. Cancellation. Fashion by Informa reserves the right to cancel the RP Fashion Event in its sole and absolute discretion, including for reasons outside of Fashion by Informa’s reasonable control. Fashion by Informa is not liable for any costs, expenses, or losses suffered by Referrer or Referee in connection with any postponement or cancellation of the RP Fashion Event. To the extent the RP Fashion Event is postponed or cancelled, Fashion by Informa will use reasonable efforts to transfer the referral to an alternative Fashion Event but is under no obligation to do so. Fashion by Informa also reserves the right to cancel, modify, suspend, or terminate the Referral Program for a specific Fashion Event and only award a Reward to those who submit a Form and attend the RP Fashion Event prior to such termination.
VI. Representation and Warranty. The Referrer represents, warrants, and covenants that

  1. all information set forth in the Form, is true, correct, and complete in all respects;  
  2. they will not mislead the public in connection with the RP Fashion Event, including, but not limited to, misrepresenting their relationship with MMGNET or the RP Fashion Event in an attempt to find a Referee to attend the RP Fashion Event;
  3. each Referee is an individual, natural person, and no fake personas were created to participate in the RP;
  4. they will not take any action to manipulate or modify the RP; and
  5. they will not misuse any of MMGNET’s trademarks, logos, or intellectual property.

The Referrer and Referee both represent and warrant they will comply with all applicable laws and regulations in connection with their participation in the RP, and will not use their participation in the RP for any illegal or unauthorized purposes. 

FASHION BY INFORMA HEREBY DISCLAIMS ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE QUALITY, SUITABILITY, BENEFIT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OF THE RP FASHION EVENT.
VII. Release and Limitation of Liability.

  1. By participating, each Referrer and Referee release and hold harmless Fashion by Informa, its affiliates and its and their respective directors, employees, representatives and agents (collectively, the “Fashion by Informa Parties”) for any liabilities, damages, losses, or claims, whether known or unknown, which arise in connection with the RP Fashion Event.  This includes, but is not limited to, claims arising from any (i) preparation for, travel to, and participation in the RP Fashion Event, or (ii) delivery, mis-delivery, possession, acceptance, use or misuse of the Reward.
  2. Fashion by Informa Parties are not liable for any inaccurate information, whether caused by website users, or by any of the equipment or programming associated with the RP, including any badge scanning device used at the RP Fashion Event. Fashion by Informa Parties are not responsible for any user fraud. 
  3. Fashion by Informa Parties are not responsible for any (i) errors in the printing, offering, or provision of the Reward, (ii) lost, late, incomplete, or invalid Forms, (iii) electronic transmission errors resulting in omission, interruption, deletion, defect, or delay in operations, (iv) transmission, theft, destruction, or unauthorized access to or alteration of Forms, or (v) failure to receive RP related information by Referrers and Referees due to technical problems. Referrers assume all risk of lost, misdirected, incomplete, or illegible Forms.
  4. Fashion by Informa will in no event be liable for any special, indirect, incidental, consequential, or punitive damages.
VIII. Miscellaneous.

  1. The Fashion by Informa Referral Program is governed by the laws of the State of New York. The courts of the State of New York have exclusive jurisdiction to resolve any dispute relating to this Agreement. Any activities intended to disrupt or interfere with the proper play of the RP will be prosecuted to the fullest extent of the law.
  2. Referrers and Referees agree that any personal information provided may be held and used by Fashion by Informa or its agents and suppliers to administer the RP and the RP Fashion Event. For more information about how Fashion by Informa uses/stores your data, see our Privacy Policy.
  3. The Fashion Events, Referral Program, and all related web pages, content, and code are the property of Fashion by Informa or its licensors. Copying or unauthorized use of any copyrighted materials, trademarks, or any other intellectual property without the express written consent of its owner is strictly prohibited.
  4. Referrers and Referees will not initiate or pursue any claim or action relating to the Fashion by Informa Referral Program or these official rules against Fashion by Informa one (1) year after the last date of the RP Fashion Event.
